SB 250 threatens safe, legal hemp beverages in Indiana
We support strong 21+ regulation—not an effective ban. This year, that means opposing SB 250 as written and urging lawmakers to support Representative Bartels’ amendment while federal rules are being finalized.
What SB 250 would do without changes
If SB 250 passes without meaningful changes, it would:
- Effectively eliminate most hemp‑THC beverages and many CBD products that Hoosiers use today.
- Treat many existing hemp drinks like illegal marijuana, with no legal path for adults to buy them in Indiana.
- Punish responsible, ID‑checking retailers who followed the rules, while pushing sales to less regulated channels or out‑of‑state sources.
This isn’t about avoiding oversight. It’s about avoiding an effective ban that hurts consumers, farmers, and small businesses who built around the framework lawmakers gave us.
What Representative Bartels’ amendment would change
Representative Bartels’ amendment replaces the “ban by stealth” approach with a regulated adult‑use hemp lane. In plain language, it would:
- Keep hemp‑THC beverages legal for adults 21+ instead of wiping them out.
- Set clear THC limits by product type (drinks, edibles, tinctures, vapes, topicals) instead of a near‑zero cap that kills the market.
- Require retailers like Swizzle to get a state permit, check IDs, follow strict labeling and testing rules, and accept inspections—essentially codifying what are are already doing.
We don’t think this framework is perfect. Some of the allowed THC limits are higher than necessary for a responsible, low‑dose market. But today, this amendment is the only realistic alternative to an effective ban.
Our preferred path for Indiana
Our ideal outcome is simple:
- Indiana should pause major changes to hemp law until federal hemp rules are updated and clarified.
- In the meantime, the state should focus on enforcing existing rules: 21+ age limits, ID checks, accurate labeling, child‑safe packaging, and clear testing standards.
We believe you can protect public safety and minors without suddenly criminalizing products and businesses that operated in good faith under prior law.

Please choose regulation over prohibition, give time for federal hemp rules to be finalized, and protect responsible Indiana consumers, farmers, and small businesses.
